MEMORANDUM OF ORAL DECISION DELIVERED BY S. BRAUN ON APRIL 25, 2024 AND ORDER OF THE TRIBUNAL
1This was the first Case Management Conference (“CMC”) held in this matter involving an expropriation by His Majesty the King in Right of the Province of Ontario as Represented by the Minister of Transportation relating to the property Municipally known as 2574 Highway 7 in the Town of Lindsay.
2The Parties have not yet engaged in settlement discussions as they await the completion of appraisal reports which are expected to be exchanged on or before Thursday, August 1, 2024. The Parties have agreed that, should they wish to avail themselves of the resource of Tribunal-assisted mediation, they will make a request for same no later than Tuesday, June 3, 2025. In the meantime, the Parties wished to schedule a hearing date and finalize a Procedural Order (“PO”). The PO appended hereto as Attachment 1 shall govern the proceedings leading up to and including the Hearing.
3The Tribunal scheduled a five (5) day Video Hearing commencing on Monday, September 15, 2025, 10 a.m. and ending on Friday, September 19, 2025.
4Parties are asked to log into the Video Hearing at least 15 minutes before the start of the event to test their video and audio connections:

7Individuals are directed to connect to the event on the assigned date at the correct time. It is the responsibility of the persons participating in the Video Hearing to ensure that they are properly connected to the event at the correct time. Questions prior to the Hearing event may be directed to the Tribunal’s Case Coordinator having carriage of this case.

Any reference to the preceding tribunals or the former Ontario Municipal Board is deemed to be a reference to the Tribunal.
