THIS MATTER having come before the Tribunal for a hearing which commenced on November 20, 2023 (“Hearing”) regarding the Claimants’ claim for compensation under the Expropriations Act, R.S.O. 1990, c. E-26 arising from an expropriation concerning part of the lands municipally known as 350 Franklin Boulevard, 352 Franklin Boulevard and 500 Main Street in Cambridge, Ontario;
AND THIS MATTER having been subject to an Order of the Tribunal dated November 30, 2023, which adjourned the Hearing due to the sudden passing of one of the Claimants during the course of the Hearing;
AND WHEREAS on receiving the Requisition of the Claimants and on reading the Affidavit of Kevin Dias dated February 28, 2024 which indicates that:
Mary Alma Corbett (“Ms. Corbett”) passed away on the 24th day of November 2023.
The Limited Property Will of Ms. Corbett appoints the following individuals as the Estate Trustees of Ms. Corbett’s estate:
(a) John Philip Taylor;
(b) Edmund Patrick Taylor;
(c) David Forte; and
(d) Walter Ferguson.
AND UPON BEING ADVISED that the Respondent in this proceeding is unopposed to the Order described below;
THE TRIBUNAL ORDERS that this proceeding shall be continued and that the title of the proceeding in all documents issued, served or filed after the date of this Order be as follows:
