THIS MATTER having come on before the Ontario Land Tribunal (the “Tribunal”);
AND THE TRIBUNAL having before it a request on consent of all parties to fully dispose of the appeals of Atlantic Packaging Holdings Ltd. & Products Ltd. and Gerdau Ameristeel Corporation;
THE TRIBUNAL ORDERS that in accordance with subsection 34(26) of the Planning Act, RSO 1990, c P.13, as amended:
- The appeals are allowed; and
- Town of Whitby By-Law No. 7729-21 is hereby repealed in its entirety.
AND THE TRIBUNAL FURTHER ORDERS that it may be spoken to in the event of any matter or matters that should arise in connection with the implementation of this Order.
