THIS MATTER having come on for public hearing and the Ontario Land Tribunal (“Tribunal”) having issued Decision on February 2, 2023 allowing the appeal to the Official Plan and allowing the appeal to the Zoning By-law on an interim basis and withheld its Final Order contingent upon confirmation, satisfaction or receipt of pre-requisite matters identified in paragraph 74 of the Decision;
AND THE TRIBUNAL having now received a request from 2540740 Ontario Inc., for a further five (5) month extension to the lapsing date of March 15, 2024 for the submission of the final drafts of the Zoning By-law Amendments and provide confirmation that all other contingent pre-requisites to the issuance of the Final Order have been satisfied or provide a written status report to the Tribunal by that date;
AND THE TRIBUNAL having received no objection from the City of Toronto for the request for the five (5) month extension;
THE TRIBUNAL ORDERS that the request to extend the lapsing provisions on the Zoning By-law Amendment to August 1, 2024, is granted.
