1October 25, 2023 was to be the first day of a three-day Hearing on the Merits of these Appeals. Upon the commencement of that day’s proceedings, the Tribunal was advised by Mr. O’Callaghan that the terms for a settlement had been reached. Counsel accordingly requested that the Hearing on the Merits be adjourned sine die, pending completion of the settlement documents and payment of the settlement amount, which request was granted by the Tribunal.
2Mr. O’Callaghan and Mr. Maloney have both confirmed that the full and final settlement of both Appeals has now been completed, and on January 15, 2024, Mr. O’Callaghan wrote to the Tribunal’s Case Coordinator advising the Tribunal that his client’s Appeals had been withdrawn.
ORDER
3As the Appeals have been withdrawn, and the Tribunal’s file has been closed as there are no further outstanding Appeals, the Tribunal makes no Order herein.
