At the request of Nicholas Rallis, the Ministry of Municipal Affairs and Housing has referred to the Ontario Municipal Board under subsection 51(15) of the Planning Act, R.S.O. 1990, c.P. 13, a proposed plan of subdivision on lands composed of Lot 37, Concession D, in the Township of Amabel (now the Town of South Bruce Peninsula)

Order
THE TRIBUNAL having issued a Partial Order on January 30, 2002 approving the proposed Draft Plan of Subdivision;
AND THE TRIBUNAL having received a request from the Parties on consent to authorize the Red Line Revision of Draft Plan of Subdivision 41T-91013; to approve the amended conditions of Draft Plan Approval; and to grant the County of Bruce the authority to clear the conditions of Draft Plan Approval and issue final approval of the Plan of Subdivision;
THE TRIBUNAL ORDERS that, pursuant to subsection 51(56.1) of the Planning Act (“Act”), the County of Bruce shall have the authority to clear the conditions of draft plan approval attached as Attachment 3, to administer final approval of the plan of subdivision for the purposes of subsection 51(58) of the Act in accordance with the Red Line Revision attached as Attachment 1 and the related Zoning Bylaw Amendment attached as Attachment 2.

The Conservation Review Board, the Environmental Review Tribunal, the Local Planning Appeal Tribunal and the Mining and Lands Tribunal are amalgamated and continued as the Ontario Land Tribunal (“Tribunal”). Any reference to the preceding tribunals or the former Ontario Municipal Board is deemed to be a reference to the Tribunal.
