BEFORE: KURTIS SMITH Tuesday, the 5th MEMBER day of March 2024
THESE MATTERS having come before the Tribunal for a settlement hearing on March 5, 2024;
AND THE TRIBUNAL, having been provided with uncontested land use planning and engineering evidence in support of the consent applications bearing Town file numbers B.15.18 and B.16.18 (the “Consents”);
AND THE TRIBUNAL, having had regard to the decisions of the Town’s committee of adjustment and the information and material related to the Consents pursuant to Section 2.1 of the Planning Act;
AND THE TRIBUNAL, having found that the Consents are consistent with the Provincial Policy Statement (2020), conform to and do not conflict with applicable provincial plans, pursuant to Section 3(5) of the Planning Act, conform to the York Region Official Plan and the Town’s official plan, and comply with the Town’s zoning by-law as amended;
AND THE TRIBUNAL, having had regard for the matters of provincial interest pursuant to Section 2 of the Planning Act and the criteria in Section 51(24) of the Planning Act, having determined that that the Consents are appropriate and constitute good planning;
AND THE TRIBUNAL, having determined that the three (3) conditions proposed are reasonable and appropriate having regard to the nature of the development proposed, in accordance with Section 51(25) of the Planning Act;
THE TRIBUNAL ORDERS that the appeals are allowed in part and that provisional consent is given to applications B.15.18 and B.16.18 are granted generally in accordance with the severance sketches attached as Schedule 1 to this Order, subject to the following conditions:
A permit will be obtained and approvals will be subject to the Lake Simcoe Region Conservation Authority (LSRCA) regulations and guidelines at the time of the application / permit submission.
Basements are not permitted.
The dwelling can only have a non-habitable crawl space.
The Tribunal may be spoken to should any Party require assistance in the execution of this Order.
