MEMORANDUM OF ORAL DECISION DELIVERED BY D. CHIPMAN AND ORDER OF THE TRIBUNAL
INTRODUCTION
1The Tribunal convened a Case Management Conference (“CMC”) in respect of appeals filed by the Appellants listed above pursuant to s. 17(24) of the Planning Act.
2Mr. Schromm on behalf of the City provided the following detailed progress update on the outstanding appeals since the last CMC.
The Sisters of Charity Appeal has been withdrawn.
Forum appeal (Orleans Town Centre, 530 Brisbois Crescent) requested, on consent, to hold this Appeal in abeyance until the parties advise otherwise.
On behalf of Brigil (11034936 Canada Inc., 8600 Jeanne D’Arc) settlement discussions are ongoing, which the City believes will progress and Settlement appears likely.
Youville district appeal (Myers/Zena and Sobeys/SDLP 1887 Orleans Limited) are in Settlement discussions which have progressed with the City.
3The Tribunal has scheduled a merit hearing on the Guibord appeal (1544775 Canada Inc, 3403 St. Joseph) which will commence on Monday, February 10, 2025. Expert witness statements have been exchanged; expert meeting has taken place. The Tribunal reviewed the amended Procedural Order and amended Issues List of the Parties as noted in the Order below.
4The Parties, known as Brigil and Youville, requested a further CMC to be held after February 10, 2025, to have additional time to discuss a possible settlement of their appeals.

5The Tribunal includes, for reference and convenience, the following coordinates for the upcoming Merit Hearing.
6The video Merit Hearing will begin on Monday, February 10, 2025, at 10:00 a.m., for a duration of three (3) days.
7A further CMC for the Parties (Brigil and Youville) will commence Tuesday, February 18, 2025, at 10 a.m. by Video Hearing.

11Persons who experience technical difficulties accessing the GoTo Meeting application or who only wish to listen to the event can connect to it by calling in to an audio-only telephone line.

It is the responsibility of the persons participating in the event to ensure that they are properly connected at the correct time. Questions prior to the event may be directed to the Tribunal’s Case Coordinator.
ORDER
13THE TRIBUNAL ORDERS a Case Management Conference for the Parties known as Brigil and Youville as directed above.
14THE TRIBUNAL ORDERS that the Procedural Order and Issues List noted as Attachment 1 to this Decision is in force and effect and will govern the Merit Hearing scheduled to begin on Monday, February 10, 2025. No amendments to the Procedural Order or Issues List are allowed without authorization by the Tribunal.
15This Member is not seized.
16No further notice will be given.
