MEMORANDUM OF ORAL DECISION DELIVERED BY T.F. NG ON NOVEMBER 25, 2024 AND ORDER OF THE TRIBUNAL
INTRODUCTION
1This is the second Case Management Conference (“CMC”) for the above-noted matter. KS AOB Toronto Inc. and Dundas Atrium Toronto Inc. (“Appellants”) have filed appeals against the City of Toronto’s (“City”) failure to make a decision within the statutory time frames for Applications to permit a 34-storey mixed-use buildingwith respect to properties 595 Bay Street, 304-316 Yonge Street, and 14-40 Dundas Street West. The appeals were pursuant to s. 22(7) and s.34(11) of the Planning Act.

2No further Party or Participant requests were received.
DRAFT PROCEDURAL ORDER
3Counsel for the Appellants, Mr. Schuman, informed the Tribunal that the Parties have filed the draft Procedural Order (“PO”) with the Issues List and requested a hearing to be scheduled. All Parties agreed with the request. The Appellants will call three witnesses, the City will call no more than three witnesses, and Sick Kids will call one witness.
4The Tribunal noted that the City’s issue no. 2 on the Provincial Planning Statement 2024, will need to be further scoped and particularized. The PO with the deadlines filled in, is to be forwarded to the case coordinator within two weeks, that is by December 9, 2024.
MEDIATION
5The Parties will continue discussions to resolve the appeal and will be open to mediation.
DISPOSITION
6The Tribunal will schedule a Video Hearing for the Parties.
