Order
THESE APPEALS having come on for a Public Hearing; and after the Hearing the Tribunal in its Decision issued August 5, 2009 having granted approval to the site specific zoning by-law and to the Draft Plans of Subdivision 22T-02002 and 22T-04004 (the "Draft Plans") subject to the fulfillment of the conditions that were imposed, and in its Orders issued on March 12, 2012, August 5, 2014, July 25, 2016, September 11, 2019, November 18, 2021 and November 24, 2022 having each granted extensions of the deadline to fulfil the conditions of approval of the Draft Plans (the "Draft Plan Conditions");
AND THE TRIBUNAL having received the Affidavit of Mike Crough, land use planner;
THE TRIBUNAL ORDERS that the lapse date of the Draft Plans is extended for two years, to December 1, 2026.
THE TRIBUNAL ORDERS that the Draft Plan attached as Appendix A to this Order is approved, subject to the Draft Plan Conditions noted below, and the Draft Plans, as approved by the Tribunal, are amended as shown. The remainder of the lands subject to the Draft Plans remain draft approved as previously approved by the Tribunal and its predecessors, subject to the updated Draft Plan Conditions attached to this Order.
THE TRIBUNAL ORDERS that the Draft Plan Conditions are amended as set out in Appendix B and Appendix C to this Order.
AND THE TRIBUNAL FURTHER ORDERS that it may be spoken to in the event some matter should arise in the connection with the implementation of this Order.
