MEMORANDUM OF ORAL DECISION DELIVERED BY F. LAVOIE ON NOVEMBER 14, 2024 AND ORDER OF THE TRIBUNAL
INTRODUCTION
1This Decision and Order arises from the first Case Management Conference (“CMC”) held regarding appeals filed by 2775 Jane Street Limited and 2204808 Ontario Inc. (“Appellants”) pursuant to subsection 17(24) of the Planning Act, R.S.O. 1990, c. P.13, in respect of the adoption of Official Plan Amendment No. 633 (“OPA”) by the City of Toronto (“City”) with respect to the Jane Finch Secondary Plan lands.
2The City adopted the OPA on June 27, 2024. Its policies would apply to the Jane Finch Secondary Plan area, being generally bounded by Highway 400 to the west, the Finch Hydro Corridor and portions of Yorkgate Boulevard and Strong Court to the north, Black Creek to the east, and portions of Black Creek, London Green Court, Yorkwoods Gate, Grandravine Drive, Wedge Court, Frith Road, Eddystone Avenue, and Firgrove Crescent to the south.
3The Appellants each own land in the Finch Secondary Plan area. Among many other things, they appeal the OPA seeking higher proposed heights on their respective lands.
PROCEDURAL MATTERS
4The Tribunal was in receipt of an Affidavit of Service sworn by Darren Armoogam, on October 7, 2024 which was marked as Exhibit 1. There were no issues with the service of notice for the CMC and, as such, no further notice is required.
5The Tribunal did not receive any requests for Party or Participant Status prior to or at the CMC.
SCHEDULING OF NEXT CMC AND DIRECTIONS FOR PROCEDURAL ORDER
6The Parties advised the Tribunal that given the appeals relate largely to site specific concerns, they request a Tribunal Order that the Appellants provide their Issues List within three weeks along with confirmation as to whether their appeals may proceed on a site specific basis. Further, the Parties seek a second CMC in early 2025, for the purposes of either a motion for partial approval of the Secondary Plan or finalizing a Procedural Order and obtaining merit hearing dates, depending on the scope of the Appellants’ appeals.
7Considering the foregoing, the Tribunal directed the Appellants to provide the Tribunal with their issues list and confirmation of whether appeals can proceed on a site specific basis by Thursday, December 5, 2024.
8The Tribunal scheduled a second CMC to proceed on Monday, February 24, 2025, at 10 a.m. by videoconference.
