In considering this matter, the Tribunal has accepted and adopted the expert opinion evidence of the Applicant’s witnesses.
THE TRIBUNAL acknowledges the cultural and architectural significance of the existing structure. However, in the absence of any firm alternative plans, it believes that the proposal preserves the importance of the Subject Site. The Tribunal encourages both parties to continue discussions with this goal in mind.
THE TRIBUNAL is persuaded by the evidence that the proposal promotes efficient development of land, accommodates a range of appropriate mixed uses, intensifies uses within the settlement area, and contributes to the range of housing options, particularly with the increase in housing options supported by mass public transit as desired by the City.
THE TRIBUNAL finds that the Revised Proposal is consistent with the policy direction established by the PPS, conforms to the relevant directives established by the Growth Plan, and as maintained by the OP. The Tribunal is further satisfied that the Revised Proposal has due regard for matters of provincial interest, is consistent with the principles of good land-use planning, and is in the greater public interest. More significantly, the proposal furthers the goals and objectives of the provincial planning regime to increase housing opportunities.
INTERIM ORDER
THE TRIBUNAL ORDERS THAT the appeals for the Official Plan Amendment and Zoning By-law are approved.
The effective date of the Tribunal’s Decision and Order is October 18, 2024. Written reasons for the decision will follow.
