MEMORANDUM OF ORAL DECISION DELIVERED BY A. Mason ON October 1, 2024 AND ORDER OF THE TRIBUNAL
INTRODUCTION
1This first Case Management Conference (“CMC”) was held concerning appeals pursuant to sections 22(7) and 34(11) of the Planning Act, R. S. O. 1990, c. P.13, as amended, with respect to the failure of the City of Toronto to make a decision within the required time period on Applications for Official Plan Amendment and Zoning By-law Amendment (“Applications”) for the properties located at 1245 and 1285 Dupont Street and 213 Emerson Avenue. The Applications would facilitate site specific amendments to permit additional height and density on lands owned by 2470347 Ontario Inc. within the approved Reimagine Galleria master planned community.

2An Affidavit of Service sworn on August 29, 2024, attesting to the giving of notice for this proceeding, was marked as Exhibit 1.
REQUESTS FOR STATUS
3In advance of the CMC, the Tribunal received one written request for Participant status from Jamie Ginter, an area resident. The Parties did not object to the request and the Tribunal granted Participant status to Jamie Ginter.
SECOND CASE MANAGEMENT CONFERENCE
4The Parties jointly requested a second CMC to provide a timeline to assist in advancing a Procedural Order and to potentially resolve some, or all, of the concerns between the Parties. The Tribunal set down Friday, February 7, 2025, for a second CMC.
5The hearing is scheduled to proceed by video on Friday, February 7, 2025 at 10 a.m.
