AMENDING DECISION OF THE TRIBUNAL DELIVERED BY K.R. ANDREWS
1In accordance with Rule 24.4 of the Tribunal’s Rules of Practice and Procedure, whereby the Tribunal may at any time and without prior notice to the parties correct a technical or typographical error made in a decision or order, the Decision and Order (“Decision”) issued on January 27, 2023, is hereby amended.
2By deleting the incorrect reference to subsection 17(36) in the first Title of Proceedings and replacing it with the corrected reference to subsection 17(24) within that Title of Proceedings as now shown in this Amending Decision.
3By also deleting paragraph [1] from the Decision and replacing it with the following:
1This is the second Case Management Conference (“CMC”) concerning appeals by six appellants/groups of appellants. The appeals are pursuant to s.17(24) and 34(19) of the Planning Act, arising from the decisions of the Town of Fort Erie to adopt Official Plan Amendment No. 56 (“OPA 56”) and Zoning By-law Amendment No. 144-2021.
4In all other respects the Tribunal’s Decision remains the same.
