UPON APPEAL to the Ontario Land Tribunal (the “Tribunal”) by Timothy Hubert (the “Appellant”) from the Notice of Refusal of Council of the Township of Whitewater Region, dated February 15, 2023, to refuse the Zoning By-law Amendment.
AND THE TRIBUNAL having provided the Appellant with a direction letter, dated May 24, 2023, directing the Appellant to serve notice of the Case Management Conference, and the Appellant having advised they did not serve notice;
AND THE TRIBUNAL having granted an adjournment and provided the Appellant with a new direction letter, dated June 30, 2023, directing the Appellant to serve notice with the new Case Management Conference date, and the Appellant not having responded or filed an affidavit of service;
AND THE TRIBUNAL having provided the Appellant with the opportunity to provide the requested information in the foregoing in accordance with s. 19(2) of the Ontario Land Tribunal Act (the “Act”), and the Appellant not having responded to the Tribunal;
THE TRIBUNAL ORDERS upon its own motion under s. 19(1)(b) of the Act that the appeal by Timothy Hubert is hereby dismissed without holding a public hearing.
