MEMORANDUM OF ORAL DECISION DELIVERED BY d.S. COLBOURNE ON may 19, 2023 AND ORDER OF THE TRIBUNAL
1This was a first Case Management Conference (“CMC“) related to a Hearing of Necessity to deal with the request for hearing length and production of a report related to the main issue raised by the Toronto Condominium Corporation (the “Corporation”) being the structural safety of the access routes to be used during construction and the evidence to be called related to that concern about the present structure at 2662 Bloor St. West.
2The City of Toronto (the “City”) and the Condo Corp. Unit Owners (the “Condo Corp”) representatives have been meeting for some time on the issues.
3Frank Sperduti indicated he would have three witnesses, Matthew Owen- King would have two witnesses and the City would have two witnesses.
4Mr. Sperduti also wished the production of the notice and documents 60 days in advance of the hearing.
5The Parties have already set aside and agreed to Monday, September 25, 2023, to Friday, September 29, 2023, for the hearing of the merits.
6Since the two main Parties are already in discussion, there is more than 60 days before the hearing date, so this is more than ample time to continue discussions on all of the issues.

7The hearing is scheduled to proceed by video on Monday, September 25, 2023, to Friday, September 29, 2023, at 10.a.m.

12The Tribunal Orders that the five-day hearing will take place on Monday, September 25, 2023, to Friday, September 29, 2023 at 10.a.m.
13The Tribunal Orders that the City will produce all documents 30 days before Monday, September 11, 2023.
14The Tribunal may be spoken to if any delay or issues arise.
15There will be no further notice.
