THIS MATTER having come before the Tribunal for a Case Management Conference (“CMC”) with respect to one of the outstanding appeals regarding Official Plan Amendment No. 379 (“OPA”).
THIS MATTER having been subject to a Decision of the Tribunal dated November 3, 2022.
AND WHEREAS one of the outstanding appeals with respect to the OPA being 17099492 Ontario Limited have been previously adjourned on a site-specific basis by the Tribunal;
AND WHEREAS the Tribunal extended the deadline for 1709492 Ontario Limited to submit a site-specific application to the City of Toronto no later than May 31, 2023;
AND WHEREAS the Tribunal ordered that in the event an application is not made by May 31, 2023, that the appeal maintained by 1709492 Ontario Limited is dismissed without further notice or direction from the Tribunal;
AND THE TRIBUNAL being notified by the City on June 14, 2023 that no application was filed by 1709492 Ontario Limited and that the City will not bring a motion for costs;
THE TRIBUNAL HEREBY ORDERS in accordance with Section 19(1)(b) of the Ontario Land Tribunal Act, 2021, S.O. 2021, c. 4, Sched. 6, that the appeal by 1709492 Ontario Limited is dismissed and no costs will be awarded against 1709492 Ontario Limited within this appeal.
