UPON APPEAL to the Ontario Land Tribunal (“Tribunal”) filed by Andrew Concannon and Alyssa Thomas from a decision of the Committee of Adjustment of the City of Burlington dated December 7, 2022;
AND UPON the motion of the Tribunal for an Order dismissing the appeal without holding a public hearing under s. 19(1)(a) of the Ontario Land Tribunal Act (“Act”);
AND THE TRIBUNAL having provided the Appellants with prior notice on May 2, 2023 and again on May 23, 2023 of the requirement to provide the fee prescribed under the Act in accordance with s. 19(2) of the Act, and the Appellants not having responded or paying the prescribed fee;
THE TRIBUNAL ORDERS that the appeal by Andrew Concannon and Alyssa Thomas is hereby dismissed.
