MEMORANDUM OF ORAL DECISION DELIVERED BY DAVID BROWN ON MARCH 2, 2023, AND ORDER OF THE TRIBUNAL
1The Tribunal convened a second Case Management Conference (“CMC”) in respect of the appeals filed by Trolleybus Urban Developments and BV Realty Partners GP Inc. (the “Appellant”) against the City of Toronto’s (the “City”) failure to make a decision on an application to Amend the Official Plan and the Zoning By-law within the timeframes prescribed in the Planning Act, R.S.O. 1990, c. P. 113, as amended.
2The Tribunal convened the CMC to consider a draft Procedural Order (“DPO”) and an Issues List (“IL”) and to set a date for the hearing of the merits of the appeals.
3The Parties provided a DPO and IL to the Tribunal on consent in advance of the CMC.
4The Tribunal reiterated its encouragement for the Parties to continue discussions with a goal of narrowing the issues and, if possible, to negotiate a settlement of this matter.
5The Tribunal scheduled a 5-day hearing to be conducted by video commencing on Monday, January 15, 2024, at 10:00 am. to consider the merits of the appeals.
6Parties and Participants are asked to log into the video hearing at least 15 minutes before the start of the event to test their video and audio connections.

11The Procedural Order attached to this decision as Attachment 1 shall govern the proceedings leading up to and including the hearing.

12THE TRIBUNAL ORDERS THAT a hearing of the merits is scheduled for 5-days commencing on Monday, January 15, 2024, at 10:00 a.m. as set out above in paragraphs [6] through [9] inclusive.

The Conservation Review Board, the Environmental Review Tribunal, the Local Planning Appeal Tribunal and the Mining and Lands Tribunal are amalgamated and continued as the Ontario Land Tribunal (“Tribunal”).
