UPON APPEAL to this Tribunal by Building Industry & Land Development Association against Education Development Charge By-law No. 191-2019 of the Toronto Catholic District School Board;

AND UPON the motion of the Ontario Land Tribunal for an Order dismissing the appeal without holding a public hearing under subsection 19(1)(b) of the Ontario Land Tribunal Act, and the Tribunal having provided the appellant with the opportunity to provide the information requested in accordance with the Act, and the appellant not having responded in the time frame specified by the Tribunal;

THE TRIBUNAL ORDERS that the Motion is granted and the appeal by Building Industry & Land Development Association is dismissed.
