THE TRIBUNAL having received a notice of appeal filed by Shelly Richardson (“Appellant”) dated August 31, 2022
AND THE TRIBUNAL having undertaken the preliminary screening of the appeal, as per Rule 15.01 of the Tribunal’s Rules of Practice and Procedure and having determined that the appeal is not valid because the Appellant did not provide oral or written submissions to council in accordance with the legislative requirements set out in subsections 34 (25);
AND THE TRIBUNAL having received a declaration from the City of Toronto dated November 24, 2022 affirming that the Clerk’s office does not have any correspondence on record from the Appellant related to the subject matter, and affirming that the Appellant did not make oral or written submissions at the June 30, 2022 Public Meeting of the Toronto and East York Community Council, with respect to the subject matter;
AND THE TRIBUNAL having issued a letter dated December 19, 2022 to notify the Appellant of the result of the preliminary screening;
AND THE TRIBUNAL having provided the Appellant the opportunity to challenge the preliminary determination and having received a response on Friday, December 30, 2022;
AND THE TRIBUNAL having reviewed the Appellant’s response and determining the response to be unsatisfactory;
THE TRIBUNAL HEREBY ORDERS that the appeal by Shelly Richardson is dismissed pursuant to subsections 19(1)(d) of Ontario Land Tribunal Act, 2021.
