UPON APPEAL to this Tribunal by 2252579 Ontario Inc., and now under the new ownership of 2816058 Ontario Inc., under subsection 41(12) of the Planning Act, R.S.O. 1990, c. P. 13, as amended, from the failure of the Town of Wasaga Beach to approve the plans within 60 days after they were submitted;
AND UPON the motion of the Ontario Land Tribunal for an Order dismissing the appeal without holding a public hearing under subsection 19(1) of the Ontario Land Tribunal Act, and the Tribunal having provided the appellant with the opportunity to provide the information requested in accordance with subsection 19(1)(b) of the Ontario Land Tribunal Act;
THE TRIBUNAL ORDERS that the appeal by 2816058 Ontario Inc. is dismissed.
