THIS MATTER having been appealed to the Tribunal for determination on the claim of injurious affection against the City of Ottawa and the Province of Ontario (“Ontario”) by Alexandre Morin (“Claimant”) concerning his property known as 717 Trim Road in the City of Ottawa;

AND THE TRIBUNAL having previously dismissed his claim against Ontario in its decision issued on April 2, 2020;

AND THE TRIBUNAL having requested that the Claimant provide an update on his claim, most recently in a letter issued on February 3, 2023 which informed the Claimant that failure to provide a response may result in the Tribunal issuing an order dismissing his appeal if no response is provided within twenty-one days of the issuance of the letter subject to section 19(1)(b) of the Ontario Land Tribunal Act which provides:

19 (1) Subject to subsection (4), the Tribunal may, on the motion of any party or on its own initiative, dismiss a proceeding without a hearing,

(b) if the party who brought the proceeding has not responded to a request by the Tribunal for further information within the time specified by the Tribunal;

AND THE TRIBUNAL having not received a response from the Claimant within the prescribed time period;

THE TRIBUNAL HEREBY ORDERS that the appeal by the Claimant is dismissed, and the Tribunal’s file is closed.
