MEMORANDUM OF ORAL DECISION DELIVERED BY jatiNder bhullar and s. mann on june 3, 2022 AND ORDER OF THE TRIBUNAL
1This was the first Case Management Conference ("CMC"). The appeal was made by Douglas Wilson ("Applicant/Appellant") for the refusal of a minor variance application by the Town of Huntsville ("Town"). The Applicant/Appellant has property municipally known as 32 King Crescent, in the Town ("Subject Property").
2There were no requests received for the granting of Party or Participant status.
3The Parties jointly informed the Tribunal that they were engaged in settlement discussions. The Parties promised to inform the Tribunal on the outcome of such discussion, in the short timeframe, so that a settlement or hearing on the merits may be set up.
4Unfortunately, the Parties ignored their promise and only more recently around April 13, 2023, provided a status update after multiple requests from the Tribunal.
5The Tribunal reluctantly allows the Parties additional time to inform about the progress and future plans for a settlement or a contested hearing.
6The Tribunal directs the Parties to inform the Tribunal no later than May 15, 2023 as to scheduling of either a hearing or a settlement hearing.
7These Members are not seized but may be reached for case management purposes.
8The directions in this Decision are so ordered.
