MEMORANDUM OF ORAL DECISION DELIVERED BY ASTRID J. CLOS AND T.F. NG ON MARCH 23, 2023 AND ORDER OF THE TRIBUNAL
INTRODUCTION
1This is the third Case Management Conference (“CMC”) for appeals filed in respect of the Town of Halton Hills’ and the Regional Municipality of Halton’s approval and adoption of Official Plan Amendment No. 44 (“OPA No. 44”). OPA No. 44 was an amendment to ensure the Glen Williams Secondary Plan (adopted in 2007) is in conformity with current provincial and regional policy.
2On March 10, 2023, the Tribunal was advised in writing by Counsel for 2147925 Ontario Inc. that their appeal filed on July 19, 2022, with respect to OPA. No 44 is withdrawn.
DRAFT PROCEDURAL ORDER AND ISSUES LIST
3A Draft Procedural Order and Issues List (“DPO”) was received from the Parties on February 10, 2023. Mr. Burton, Counsel for the Town of Halton Hills advised that the DPO will be revised to remove the issues raised by 2147925 Ontario Inc. who have withdrawn their appeal.
4Mr. Arnold, Counsel for the remaining Appellants updated the Panel noting that his clients have long-standing site-specific planning applications proceeding through the local process and requested additional time prior to a hearing being scheduled. Counsel advised that this time would assist the Appellants in further scoping the issues for a contested hearing, or reaching a proposed settlement agreement, or withdrawing these appeals. Counsel for the Town concurred and jointly with the Appellants’ counsel requested that a CMC date be fixed in late September 2023 to enable parties to facilitate the ongoing discussions and potentially resolve the appeals. The other parties did not object to the request.
5On consent, the Tribunal directed that a revised DPO be filed no later than Monday, September 11, 2023. If a problem arises with respect to meeting this deadline, the Parties are to advise the case coordinator as soon as this is reasonably known.
