INTRODUCTION
1The Tribunal convened a second Case Management Conference (“CMC”) on an appeal filed by Alexandra Stevenson (“Appellant”) against the Township of Ashfield- Colborne-Wawanosh (“Township”) Council decision related to an Official Plan Amendment (“OPA”) application concerning 81421 Champlain Boulevard (“Subject Lands”).
2The OPA application would update the Ashfield-Colborne-Wawanosh (“ACW”) Official Plan (“OP”) following a Five-Year Review of the Plan. The Township identified a total of 64 acres of ‘Settlement Area’ lands which are proposed to be relocated; the recommended location for ‘Settlement Area’ designation adjustment is Part Block A, Concession Western Division, Colborne Ward, known municipally as 81421 Champlain Boulevard.
3The Appeal focusses on section 8.10 Settlement Area and section 8.6.4 (5) Residential Park Policies of the OPA. Previously, the Subject Lands were designated as prime agricultural lands by the Township Official Plan and the Huron County Official Plan. The Appeal claims the creation of a new Settlement Area in place of prime agricultural lands is not consistent with the Provincial Policy Statement (“PPS”). A comprehensive review is required before changes are made to designations.
HEARING
4The Tribunal received two separate draft Issues Lists. The Appellant’s Issues were prefaced with extensive preamble on the possibility of calling a witness to comment on the compatibility and proximity of the Subject Lands to the airport. The Applicant and counsel to the County raised concerns with how these topics were relevant to the appeal of the OPA review process and how such an individual would be qualified.
5The Tribunal directed the Appellant to consolidate her Issues List to be more definitive to the appeal on file with the Tribunal which focuses on concerns relating to the OPA process.
6The Tribunal canvassed the Parties as to the number of witnesses anticipated to provide testimony. It was agreed that a three-day (“3-day”) hearing of the merits would be in order.
7The Parties were directed to submit a draft Procedural Order (“PO”) for the consideration of the Tribunal, to the Case Coordinator on or before Friday, February 17, 2023. It was noted that the Parties were to further dialogue to ensure the draft (“PO”) was submitted inclusive of all issues for the hearing of the merits and on consent.
8The Parties notified the Case Coordinator, prior to the issuance of this decision, that attempts at culminating an Issues List on consent have failed and are now requesting that a further CMC be arranged to move this matter forward. It is the position of the Tribunal that in granting a further CMC, the Parties will provide the draft PO and Issues Lists to the Case Coordinator 10 days in advance of CMC and be prepared to finalize the draft PO and scoped Issues Lists at that time.
9Based on the number of issues identified, it will be determined whether the number of days set aside for the hearing of the
