MEMORANDUM OF ORAL DECISION DELIVERED BY BITA M. RAJAEE ON OCTOBER 27, 2022 AND INTERIM ORDER OF THE TRIBUNAL
INTRODUCTION
1This hearing was convened on October 27, 2022, to consider the appeals by Block (Vaughan Road) Developments Limited (“Applicant”) pursuant to s. 45(12) of the Planning Act for Minor Variances Approval and s. 114(15) of the City of Toronto Act for a Site Plan Approval (“Appeals”). The Minor Variances Appeal arises from the refusal of the City of Toronto’s (“City”) Committee of Adjustment (“COA”), on May 18, 2022, to approve the Variances. The Site Plan Appeal arises as no decision has been made by the City on the Site Plan Application.
2The Appeals pertain to lands known municipally as 129-141 Vaughan Road in the City (“Subject Property”). The purpose of the Appeals is to facilitate the development of a 15-storey mixed use apartment building on the Subject Property (“Proposed Development”).
3No issues were raised with service of the Notice of this Hearing event. Prior to the hearing, the Parties confirmed that a settlement had been reached and the agreement would be presented to the Tribunal for approval.

4The Applicant is seeking nineteen (19) variances to the City’s Zoning By-law No. 569-2013 (“ZBL”), as detailed in Schedule A, which is attached to this Decision.
