MEMORANDUM OF ORAL DECISION DELIVERED BY CARMINE TUCCI ON January 23, 2023, AND ORDER OF THE TRIBUNAL
1This is the second Case Management Conference (“CMC”) for this case.
2The purpose of the CMC was to receive status updates from all parties to organize the hearing of these appeals.
3The purpose of this proposed Official Plan Amendment (“OPA 131”) is to revise policies pertaining to height and urban design in the Lakeview Local Area Plan of the City of Mississauga (“City”).
4The lands affected by OPA 131 are located along Lakeshore Road East between Seneca Avenue and the Etobicoke Creek. The subject lands are located in the Lakeview Neighbourhood Character Area, as identified in the City’s Official Plan. Council of the City approved this amendment.
51407 Lakeshore Developments Inc. is the owner of a site-specific property located within the OPA 131 area at 1041 and 1407 Lakeshore Road East. The lands of 2828778 Ontario Inc., at 420 Lakeshore Road East, is also in the OPA 131 area.
6The Tribunal was informed that 2828778 Ontario Inc.’s site specific appeal at 420 Lakeshore Road East referenced by OLT case no. 21-001142 and 21-00143 and the appeal against the Comprehensive Secondary Plan OPA 131 have been withdrawn.
7Mr. Longo informed the Tribunal that his client will retain their appeal regarding the site specific issues at 1407 and 1041 Lakeshore Road East and general policies in OPA 131
8The Tribunal heard that the City is continually reviewing the Applications and hope that a favourable recommendation will be forthcoming in the near future.
9The Parties have asked for a third CMC to present any new information.
10The Tribunal hereby schedules a third CMC of these proceedings on Tuesday May 23, 2023, at 10 a.m. for one day, by video hearing.
