1This Decision arises from a Case Management Conference (the "CMC") before the Ontario Land Tribunal (the "Hearing Office") regarding an appeal by Pawanpreet Khaur and Rosa and Sonjia Vascotto concerning the conditional approval granted by the Niagara Escarpment Commission ("NEC") for the demolition of a one-storey single dwelling and the construction of a two-storey single dwelling, at the property located at 134 Tremaine Road, in the Town of Milton.
2Prior to the commencement of the CMC:
(i) Pawanpreet Khaur withdrew their appeal, such that the remaining appellants consisted of Rosa and Sonjia Vascotto (the "Appellants"); and,
(ii) the Appellants requested, and were granted, permission to be excused from the CMC for medical reasons.
3At the CMC, counsel for the Applicant requested that the CMC be rescheduled as soon as possible in order that the Parties may have an opportunity to review and narrow the issues which are the subject of the appeal without undue delay to the Applicant. The Hearing Office agreed to contact the Appellants by email in order to determine a suitable time to reschedule the CMC.
4Following confirmation of the Appellants' availability by email, the Hearing Office orders a subsequent CMC to be held on Friday, November 24, 2023, at 2 p.m. by video.
