MEMORANDUM OF ORAL DECISION DELIVERED BY Carmine Tucci ON july 14, 2023 AND ORDER OF THE TRIBUNAL
1This is the third Case Management Conference (“CMC”) for this file.
2The purpose of the CMC was to receive status updates from all Parties to organize the Hearing of these appeals.
3The Tribunal is in receipt of an email from Counsel for 1407 Lakeshore Development Inc., Mr. Leo Longo.
4On consent, the Parties included details pertaining to the appeal for 1407 Lakeshore Road East (the “1407 Site”) within the correspondence.
5The specific details comprise:
A site-specific Official Plan Amendment (“OPA 160”) was adopted on June 28, 2023, for the site municipally known as 1407 Lakeshore Road East;
The final day for an appeal of OPA 160 is July 26, 2023;
OPA 160 modifies OPA 131 as it relates to the 1407 Site;
The Ontario Land Tribunal (“OLT”) will be advised after the appeal period of whether any appeal was filed against OPA 160;
If there is no appeal, the OLT is to close its file on OPA 131 as it relates to the appeal related to the 1407 site; and
If an appeal is filed; the OLT is to schedule a further CMC to discuss the existing OPA 131 appeal and the OPA 160 appeal.
6The Tribunal was asked to adjourn the appeal of OPA 131 related to the site municipally known as 1041 Lakeshore Road East.
7A request for an additional CMC was sought by the Parties in late 2023, to provide updates to the Tribunal.
8The Tribunal hereby schedules a fourth CMC, to proceed by video, commencing on Wednesday, November 29, 2023, at 9 a.m.
