ORDER
THIS MATTER having been appealed to the Tribunal by Dunpar Developments Inc. as a result of Council of the City of Mississauga’s passage of By-law No. 0008-2023 (the “By-law”), a zoning by-law amendment which amended By-law 0225-2007;
AND THE TRIBUNAL having received a request from the City of Mississauga that the Tribunal issue an order on its own motion, pursuant to subsection 34(31) of the Planning Act, to have the parts of the By-law not at issue, namely, sections 2-4, 6, 8-10 and 14, come into force as of the date it was passed;
AND THE TRIBUNAL having confirmed that the sole appellant in this matter, Dunpar Developments Inc., (the “Appellant”) did not appeal those parts of the By-law, and that those parts of the By-laws are not at issue in the Appeal;
AND THE TRIBUNAL having received confirmation that the Appellant has consented to this request;
NOW THEREFORE
THE TRIBUNAL ORDERS on its own motion, pursuant to section 34(31) of the Planning Act, that sections 2-4, 6, 8-10 and 14 of By-law No. 0008-2023 (the “By-law”) of the City of Mississauga not in issue in the appeal shall be deemed to have come into force on January 18, 2023, which is day that the By-law was passed.
This Member is not seized.
