MEMORANDUM OF ORAL DECISION DELIVERED BY DANIEL NELSON AND S. TOUSAW ON SEPTEMBER 12, 2023 AND ORDER OF THE TRIBUNAL
This first Case Management Conference (“CMC”) was convened for the appeal of 2477454 Ontario Inc. (“Appellant”) to By-law No. 159-2022 of the County of Prince Edward (“PEC”) to designate the Wellington Heritage Conservation District and adopt the associated Heritage Conservation District Plan.
With no concerns raised regarding Notice of this CMC, PEC’s Affidavit of Service of Notice was marked as Exhibit 1.
The Appellant and PEC intend to seek Tribunal-led mediation to reduce or resolve the Appellant’s issues. Subject to the timing and outcome of mediation, the Parties anticipate outlining next steps and requesting a second CMC in late 2023.
The Tribunal supported the Parties’ pursuit of mediation and directed them to advise the Case Coordinator in due course on requested next steps, when known.
No written requests for Party or Participant status were received prior to this CMC. Several members of the public attended the CMC and were directed, should they wish to seek status, to file with the Case Coordinator by email the necessary Request Form for consideration at the next CMC. The persons in attendance were advised to inform themselves of the role and responsibilities of Party or Participant status through the Tribunal’s website before filing a request.
