THIS MATTER having come on for public hearing and after the hearing, the Ontario Land Tribunal in its Decision issued April 6, 2023 and in its Amended Decision issued April 17, 2023 granted approval to By-law later numbered as The Corporation of the City of Barrie By-law No. 2023-057;
AND THE TRIBUNAL having received a request from the Applicant/Appellant to revise By-law No. 2023-057 as approved as per Attachment 1 in the Decision issued April 6, 2023;
AND THE TRIBUNAL having reviewed the request and determining that the requested minor change submitted on consent is consistent with its previous decision and Order;
THE TRIBUNAL ORDERS that By-law No. 2023-057, the amendment to By-law No. 2009-141, attached as ‘Attachment A’ is approved.
Pursuant to Rule 24.3 of the Tribunal’s Rules of Practice and Procedure, this Order shall be, and was, effective as of the date of the hearing of this Appeal, and the delivery of the Oral Decision and Order of the Tribunal, on October 11, 2022.
