MEMORANDUM OF ORAL DECISION DELIVERED BY STEVEN COOKE ON JANUARY 31, 2022 AND ORDER OF THE TRIBUNAL
INTRODUCTION
1The matter before the Tribunal is an appeal under s. 41 (12) of the Planning Act, for the failure of the City of Toronto (“City”) to make a decision on an application of a site plan, submitted by GCD Trustee Ltd. (“Applicant”) for the property municipally known as 2540 Gerrard Street East (“Subject Site”).
2At the joint requests of the Parties the scheduled hearing has been converted into a Case Management Conference (“CMC”). The Tribunal was informed that the Parties have continued their discussion in a positive manner. A meeting between the Applicant and the City staff resulted in revisions to the application of the site plan, to address concerns raised by the City.
3The Parties have requested a further CMC date be added to the Tribunal’s calendar to allow the Parties to continue their discussion with the hopes of resolving the outstanding issues.
4The Tribunal has scheduled the next CMC to proceed by video on Monday, June 6, 2022 at 10 a.m.
5Parties and participants are asked to log into the video hearing at least 15 minutes before the start of the event to test their video and audio connections:
