THE TRIBUNAL having received a Notice of Appeal filed by Lydia Hanson (“Appellant”) dated August 18, 2022;
AND THE TRIBUNAL having undertaken the preliminary screening of the appeal, as per Rule 15.1 of the Tribunal’s Rules of Practice and Procedure and having determined that the appeal is not valid because the Appellant did not provide oral or written submissions to council in accordance with the legislative requirements set out in subsection 17(24) of the Planning Act;
AND THE TRIBUNAL having received a declaration from the City of Toronto dated August 22, 2022 affirming that the Clerk’s office does not have any correspondence on record from the Appellant related to the subject matter, and affirming that the Appellant did not make oral or written submissions at the Public Meeting held on June 27, 2022, with respect to the subject matter;
AND THE TRIBUNAL having issued a letter dated September 22, 2022 to notify the Appellant of the result of the preliminary screening;
AND THE TRIBUNAL having provided the Appellant the opportunity to challenge the preliminary determination and despite receiving communication on October 12, 2022, received no challenge by the Appellant to the documentation and information provided to the Tribunal confirming that the Appellant failed to provide the mandatory oral or written submission, as required by s. 17(24) of the Planning Act;
THE TRIBUNAL HEREBY ORDERS that the appeal by Lydia Hanson is dismissed pursuant to subsection 17(45) of the Planning Act.
