MEMORANDUM OF ORAL DECISION DELIVERED BY HUGH S. WILKINS ON AUGUST 30, 2022 AND ORDER OF THE TRIBUNAL
1On August 30, 2022, the Tribunal held a status hearing regarding the proceeding brought by 470698 Ontario Ltd. ("Claimant") seeking compensation from Her Majesty the Queen in Right of the Province of Ontario, as represented by the Minister of Transportation ("Ministry"), regarding the expropriation of lands in the Town of Tecumseh.
2At the status hearing, the Ministry stated that it is very close to reaching a settlement with the Claimant and expressed confidence that a resolution could be reached within three weeks.
3The Tribunal directed that a further status hearing will be held in September 2022. It directed that the Parties inform the Tribunal Case Coordinator if a settlement is reached before that time to convert the session to a settlement hearing, if needed.
4If no settlement is reached, the Tribunal directs the Parties to be prepared to have hearing dates set at the next status hearing and to file a draft Procedural Order and Issues List with the Tribunal by no later than Monday, September 26, 2022.
5The Tribunal orders that the further status hearing will be held by telephone conference call on Wednesday, September 28, 2022 commencing at 9 a.m.
