The applicant appealed the Town of Grimsby's failure to make decisions on Official Plan and Zoning By-law amendments to permit a six-storey mixed-use building, as well as the Town's refusal of demolition permits and Notices of Intention to Designate two heritage dwellings on the site. The Tribunal found that the two dwellings possessed cultural heritage value related to early tender fruit farming and should be retained rather than demolished. However, the Tribunal also found that the site was appropriate for medium-scale mixed-use intensification. The Tribunal denied the demolition permits, recommended the properties be designated under the Ontario Heritage Act, and approved the planning amendments in principle, directing the parties to revise the development plans to incorporate and preserve the heritage structures while allowing the mixed-use building.
