MEMORANDUM OF ORAL DECISION DELIVERED BY DAVID L. LANTHIER ON JULY 21, 2022 AND INTERIM ORDER OF THE TRIBUNAL
INTRODUCTION
1This is the first Case Management Conference (“CMC”) conducted for these many appeals filed in relation to City Council’s adoption of an amendment to the City’s Official Plan relating to development within the area of influence of rail facilities, Official Plan Amendment No. 536 (“OPA 536”) on March 9, 2022.
2The Affidavit of Service of the Notice of the CMC (by email) of Raneisha Hemmings sworn June 16, 2022 is marked as Exhibit 1 to the CMC.

THE APPEALS
4There were originally 46 Appeals filed with the Tribunal, as listed in Schedule 1 to the Title of Proceeding.
5As a result of matters addressed during this CMC, there have been modifications to the total number and form of the Appeals now before the Tribunal. Those modifications addressed and dealt with by the Tribunal during this CMC are as follows:
(a) Prior to the CMC, the Tribunal received requests from both ACEC and OSPE that they requested Party status in the Appeals. At the CMC, counsel for the two entities advised the Tribunal that as a result of discussions with the City, ACEC and OSPE wish to formally withdraw their Appeals on the understanding that they would instead participate in the hearing of the Appeals as added Parties. Following inquiries by the Panel Member, counsel for ACEC and OSPE acknowledged that they would be governed by the limitations imposed by Rule 8.3 of the Tribunal’s Rules of Practice and Procedure and would be providing input to the City in accordance with the timelines, identifying those issues and Parties for the purposes of sheltering.
(b) Counsel for H&R REIT advised the Tribunal that although the Appeal had been filed on behalf of that corporate entity, and H&R Developments and H&R Property Management. H&R REIT would be the sole Appellant of Record as the Appeals move forward. The two other related corporations H&R Developments and H&R Property Management will remain as added Parties sheltering under those issues advanced by H&R REIT.
6The revised List of Appeals, their assigned Appeal Number, and the Representative of each Appellant appended to this Decision as Attachment 1 shall be used for the purposes of continuing case management.
7Submissions were made by counsel for certain Appellants providing points of clarification with respect to their appeals. Those matters are as follows:
(a) Counsel for RioCan Holdings Inc., 2075936 Ontario Ltd. and 2076031 Ontario Limited noted on the record that the Appeal filed by these three Appellants relate to 35 separate sites, the details of which will be provided to the City;
(b) The Appellant 2530507 Ontario Inc. confirmed that through a clerical error the Appeal form had identified the appeal as being brought under s. 22(7) of the Planning Act, rather than s. 17(24). The City took no position on this request. This correction is noted for the purposes of this Appeal;
(c) Similarly, Canadian National Railway Company also communicated with the Tribunal in advance of the CMC, and confirmed on record that a similar clerical error had been made with respect to its appeal which is being brought pursuant to s. 17(24). No objection was expressed by the City, and this correction to this Appeal is also confirmed; and,
(d) Finally, as a result of inquiries by the Panel with the City, it was confirmed that a clerical error was also made within the original Submission Form filed by the City, which noted that the Appeals were before the Tribunal pursuant to s. 17(36). The Appeals before the Tribunal are filed as appeals of a decision of the City, which requires no Ministerial or other approval and are thus, filed under s. 17(24) of the Planning Act.
REQUESTS FOR PARTY STATUS
8The Tribunal received seven Requests for Party Status in advance of the CMC. Each of the parties requesting status identified, where applicable, the sites which they owned and the proximity of the sites to rail facilities. In the absence of any objections or concerns from the City or any other Party, the Tribunal granted Party status to all corporate entities, upon the understanding that they would be providing the particulars with respect to the Appellants’ Issues under which their respective Appeals will shelter as provided for below. This includes ACEC-Ontario and OSPE, who withdrew as Appellants of record and will proceed as Added Parties.
9The seven entities granted Party Status in these Appeals, inclusive of H&R Developments and H&R Management who requested to participate as added parties sheltering under Appellant No. 36, are noted in the appended Attachment 1, and are as follows:

10The Tribunal was addressed by counsel for two other corporate entities who confirmed that they were, at this hearing event, only observing but represent clients who have expressed an interest in being added as parties to the proceeding if they feel it necessary to do so.
11The first was North Edge Properties Ltd. represented by Mr. Paul DeMelo as counsel and the second was Parc Downsview Park / Canada Lands Corporation represented by Naomi Mares and Eileen Costello. Both of these interested parties (“Interested Parties”) wish to reserve the right to request Party status at the next CMC, and have agreed that they will review the List of Issues to be circulated and submitted by all of the Appellants by the date indicated below and will then, if they do wish to request Party status, submit their proposed Issues List and make the necessary request for Party status to the Tribunal. Whether the Interested Parties will be granted Party Status will then be addressed at the next CMC. The City had no objection to this process.
12It was suggested by the City that with the exception of only these two Interested Parties, that the final list of Added Parties be confirmed on a conclusive basis as of the date of this first appearance and the “door closed” to the addition of any further Parties to the proceeding. Mr. Foderick provided a submission to the Tribunal that it would be premature to bar any further Parties to the proceeding and that any such request, if it were brought, be dealt with by the Tribunal on its merits.
13The Tribunal is not prepared to absolutely bar any further party from requesting Party (or Participant) status at this point, and any such request will be dealt with at the appropriate time. That being said, with notice of this CMC having been provided, the opportunity having been given to any entity to request status at this first CMC, and with the processes that will now be undertaken to move forward to the next CMC, the Tribunal will, on a go-forward basis, be mindful of the factors to be taken into account if such later requests are made to the Tribunal, inclusive of whether there will be prejudice to the City, the Appellants, the Parties or the proceeding as it will hereafter move forward.
MEDIATION
14There may be interest by the Parties in proceeding to Tribunal-led mediation in some or all of the Appeals, but at this point, it is too early to know how that may unfold. The possibility of mediation will again be addressed at the next CMC but if ongoing discussions between now and the next CMC lead to a decision to proceed to mediation on any number of the Appeals, counsel are encouraged to contact the Tribunal’s mediation staff at the earliest opportunity.
FURTHER STEPS AND SECOND CMC
15Subsequent to the CMC, at the request of the Panel, the City submitted its revised and consolidated list of Appellants and added Parties for the purposes of ensuring consistency and accuracy. The City’s version, which is appended to this Decision as Attachment 2, also included additional email contact information for the representatives of record and in attendance at the CMC and notably, identified for each Appeal, those Land Referred to in the Notice of Appeal. The identification of the Lands referred to in the Appeal have not, at this point, been reviewed or confirmed by the Tribunal but this information may be of assistance as the Tribunal and Parties move forward with case management.
16The City indicated a commitment to entering into discussions with each of the Appellants for the purposes of coordinating a consolidated issues list and determining those site-specific issues that may exist for certain Appellants. The City is committed to having without prejudice discussions with all Appellants and Parties. The intent is to begin formulating a framework for the proposed organization of the Appeals and the hearing, or hearings, based upon the Issues Lists to be provided by each of the Appellants, and the Added Parties. The City proposes a two-step process for the circulation and submission of the Issues Lists from all Appellants and added Parties with a second CMC to be conducted in late November or early December. The option of Tribunal-led Mediation will also be discussed.
17On or before Monday, October 3, 2022, each of the Appellants will deliver to the City, with concurrent circulation to all other Appellants, Added Parties and the Interested Parties, their Issues List identifying all textual/policy consolidated issues in relation to OPA 536 and all site-specific issues.
18On or before Wednesday, October 12, 2022, each of the Added Parties, and the Interested Parties, should they intend to request Party Status, will then deliver to the City, with concurrent circulation to all other Appellants, Added Parties and the Interested Parties, those identified Appeals/Appellants listed in Attachment 1, under which they intend to shelter for the purposes of the hearing of the Appeals, and those specific Issues under which they intend to shelter.
19On or before Wednesday, October 26, 2022, the City shall then assemble and deliver to the Tribunal, copied to all Appellants, Added Parties and the Interested Parties, a Compendium of Issue Lists and Submissions received from all of the Appellants, Added Parties and the Interested Parties, following the numerical order of the listed Appellants and Added Parties set out in Attachment 1.
20A further CMC is accordingly scheduled to proceed by video hearing on Thursday, December 1, 2022 at 10 a.m.

24Individuals are directed to connect to the event on the assigned date at the correct time. It is the responsibility of the persons participating in the hearing by video to ensure that they are properly connected to the event at the correct time. Questions prior to the CMC hearing event may be directed to the Tribunal’s Case Coordinator having carriage of this case.
25If either of the Interested Parties intend to request Party Status, and if opposed by the City or other Appellant, they will serve and file any Motion materials in support of such request, prior to the second CMC, in accordance with the Tribunal’s Rules of Practice and Procedure.
26On or before Friday, November 25, 2022, the City shall provide, as may then have been completed, the following to the Case Coordinator-Planner:
(a) a draft Procedural Order for a video hearing containing the proposed Issues List based upon the submissions of all Appellants and Parties, ready for review and consideration by the Tribunal. In the event there is an unresolved dispute with respect to the form of any of the issues, or pre-hearing procedural matters to be addressed the City will provide a summary, succinctly setting out those matters in dispute relating to the Procedural Order and Issues List that remain to be determined by the Tribunal, and the position of the party on each unresolved issue or pre-hearing procedural matter;
(b) to the extent then possible, an estimate as to the total number of days required for the hearing(s).
27The Parties are expected to attend to the CMC prepared to address all matters relating to the Procedural Order, Issues List and the scheduling of a hearing, or hearings if required, on the merits of the Appeals. As well, if the Parties are ready to request hearing dates, and to assist in the scheduling of the hearing, based on the estimated time periods required to satisfy all deadlines for all pre-hearing requirements for the hearing, the Parties are also to be prepared to advise the Tribunal as to the earliest start-date that a video hearing(s) of the Appeals may be scheduled by the Tribunal and provide any conflict dates for counsel and proposed witnesses following that earliest date of availability for the commencement of the hearing(s).
28There will be no further notice with respect to the second CMC. The Panel Member is not seized, but for the purposes of continuity, to the extent that the Tribunal’s calendar may permit, the Panel Member may continue to assist with Case Management.
29The Tribunal so orders and provides these CMC directives for the purposes of the case management of these appeals.
