WHEREAS Ron Gallagher and Matthew Richard (“Appellants”) appealed the passing of Bylaw 7713-21 in relation to the property at 4618 Country Lane (“subject property”);
AND WHEREAS the Tribunal held a hearing on the merits on October 28, 2021;
AND THE TRIBUNAL having heard the submissions of the Parties and having dismissed the Appeals in its Decision issued November 18, 2021, withholding its Final Order;
AND THE TRIBUNAL having received confirmation from the Applicant that a Change of Use Permit has been granted by the Town of Whitby to the Durham Islamic Centre and the final form of By-law No. 7713-21 has been received.
THE TRIBUNAL ORDERS that the Zoning By-law number 7713-21 is approved by the Tribunal and attached to this Order as Attachment 1.
