MEMORANDUM OF ORAL DECISION DELIVERED BY WILLIAM MIDDLETON ON JUNE 2, 2022 AND ORDER OF THE TRIBUNAL
1This matter came before the Tribunal on June 2, 2022 for a second Case Management Conference (“CMC”), which was held by telephone conference call.
2The appeal is under section 14 of the Development Charges Act, 1997, S.O. 1997, c. 27 and relates to Development Charges By-law No. 77-2020 of the Region of Peel.
3The first CMC was held before Vice-Chair Makuch on July 29, 2021, and the Tribunal will not repeat the detailed recital of the background of this appeal as set out in his Decision issued August 11, 2021.
4The original merits hearing date for this matter was May 17, 2020 which was adjourned by the Tribunal on consent. Also on consent an Amended Procedural Order (“PO”) was issued by the Tribunal, which, inter alia, set out a new hearing date commencing November 28, 2022.
5The Parties are continuing their negotiations aimed at either narrowing the issues on the appeal or achieving a full resolution and were advised of the availability of the mediation resources of the Tribunal should they require assistance.
6Counsel for the Parties advised that they will contact the Tribunal in the event that a further CMC is required or to further revise the PO to reflect a changes in the issues list, or to seek a settlement hearing if a resolution is concluded.
7I will remain available in the event that further case management assistance is required.
