Memorandum of oral decision DELIVERED BY Hugh s. Wilkins on October 29, 2021 AND ORDER
1This Decision arises from a Case Management Conference (“CMC”) brought before the Ontario Land Tribunal (in its role as the Niagara Escarpment Hearing Office) regarding appeals brought by Joanne and Blair Grysak and Joanne Woodcock (“Appellants”) regarding the approval by the Niagara Escarpment Commission of a development permit to allow the placement of a special events tent on the property located at the David Springer Estate at 2372 Dundas Street in the City of Burlington.
2At the CMC, the Parties identified issues to be adjudicated at a hearing, including noise, land-use compatibility, and, possibly, traffic and parking. They discussed opportunities for settlement discussions and agreed to meet in order to identify means to resolve the appeals. The Parties requested that a further CMC be held after they have had these discussions. On December 6, 2021, the Parties provided a written update on the status of the proceeding stating that the Parties had met and settlement discussions were progressing. The Hearing Office scheduled a further CMC for January 2022 and requested that the Parties be prepared at the next CMC to identify witnesses, determine the amount of hearing time needed, file a draft Procedural Order and Issues List, and have hearing dates set.

3The Hearing Office orders that a further CMC in this matter will be held by telephone conference call on Monday, January 24, 2022 commencing at 10 a.m.
