THIS MATTER having come on for public hearing, and the Tribunal in its Decision issued on October 12, 2021 (“the Decision”), having withheld its Order pending the confirmation from parties that a Site Plan agreement has been executed, and the Tribunal having been notified that the Site Plan agreement has now been executed;
THE TRIBUNAL ORDERS that the appeal is allowed, and Zoning By-law No. 38-2007 is amended as set out Attachment “1” to the Decision, and the Site Plan is approved as set out in Attachment 2 to the Decision.
