THIS MATTER having come on for a public hearing on April 28, 2021 before the Local Planning Appeal Tribunal (continued as the Ontario Land Tribunal, the “Tribunal”);
AND WHEREAS by way of a decision issued on May 18, 2021 (the “Decision”), the Tribunal determined that certain appeals under subsections 17(36) and 34(19) of the Planning Act and (together, the “Appeals”) should be allowed, in part, and approved in principle amendments to the former City of Toronto Official Plan and amendments to former City of Toronto By-law No. 438-86, as amended by By-law No. 1174-2010, with respect to the properties known municipally in the City of Toronto as 351-369 Lakeshore Boulevard East, but withheld its final order pending confirmation from the City Solicitor that a section 37 agreement has been executed and that a final official plan amendment and zoning by- law amendment have been settled and submitted to the Tribunal;
AND THE TRIBUNAL having been advised that a section 37 agreement has been executed and that the final official plan amendment and zoning by-law amendment have been settled;
AND THE TRIBUNAL having been provided the final official plan amendment and zoning by-law amendment;
AND THE TRIBUNAL being satisfied that its direction as set out in the Decision has been met;
THE TRIBUNAL ORDERS that the Appeals are allowed, in part; that the former City of Toronto Official Plan is hereby amended in the manner set out in Attachment “1” to this Order; and City of Toronto By-law No. 438-86, as amended by 1174-2010, is hereby amended in the manner set out in Attachment “2” to this Order. The Tribunal authorizes the municipal clerk to format, as may be necessary, and assign a number to these instruments for record keeping purposes; and
THE TRIBUNAL ORDERS that notwithstanding anything ordered above, the Tribunal hereby retains the jurisdiction to consider and approve modifications to regulations, schedules and associated text approved herein as may be appropriate to dispose of any of the outstanding appeals before the Tribunal.
