THE TRIBUNAL having received a notice of appeal filed by John Hartley dated March 15, 2022;
AND THE TRIBUNAL having undertaken the preliminary screening of the appeal, as per Rule 15.1 of the Tribunal’s Rules of Practice and Procedure and having determined that the appeal is not valid because the appellant did not provide oral or written submissions to council in accordance with the legislative requirements set out in subsections 17(24) and 34(19) of the *Planning Act*;
AND THE TRIBUNAL having received a declaration from the City of Toronto dated April 13, 2022 affirming that the City Clerk’s office does not have any correspondence on record from the appellant related to the subject matter, and affirming that the appellant did not make oral or written submissions at the Statutory Public Meeting of the Scarborough Community Council held on October 15, 2021, with respect to the subject matter;
AND THE TRIBUNAL having issued a letter dated April 26, 2022 to notify the appellant of the result of the preliminary screening;
AND THE TRIBUNAL having provided the appellant the opportunity to challenge the preliminary determination and having received a response on April 27, 2022;
AND THE TRIBUNAL having reviewed the appellant’s response and determining the response to be unsatisfactory;
AND THE TRIBUNAL having received no additional response from the appellant by the deadline of May 10, 2022 provided in the letter issued April 26, 2022;
THE TRIBUNAL HEREBY ORDERS that, in accordance with Rule 15.4 of the Tribunal’s Rules of Practice and Procedure, the appeal by John Hartley is dismissed pursuant to subsections 17(24) and 34(19) of the *Planning Act*.
