MEMORANDUM OF ORAL DECISION DELIVERED BY S. deBOER AND R.G.M. MAKUCH ON APRIL 14, 2022 AND ORDER OF THE TRIBUNAL
1This is the first Case Management Conference (“CMC”) conducted in respect of the appeal from Winzen Vista Ridge Estates Limited (“Winzen”) pursuant to s. 22(7), s. 34(11) and s. 41(12) of the Planning Act against the City of Toronto’s (“City”) failure to make a decision within the statutory time frames regarding Winzen’s proposed City of Toronto Official Plan (“OP”) Site and Area Specific Policy and the former City of North York Zoning By-law No. 7625 Amendment (“ZBA”).
2The municipal address for the subject property is 1304, 1306 and 1308 Wilson Avenue, Toronto. The subject property currently contains two single storey detached dwellings and a vacant lot previous occupied by a transformer station. It is approximately 0.218 hectares in size, with a frontage of 49 metres along Wilson Avenue. The rear of the properties slopes downwards towards the northern property line and is vegetated.
3The application under appeal proposes to amend the former City of North York Zoning By-law No. 7625 from Multiple-Family Dwellings Fifth Density Zone (RM5) to Multiple-Family Dwellings Sixth Density (RM6) Zone, with special provisions for specific development standards relating to lot coverage, height, setbacks, maximum Gross Floor Area (“GFA”), and parking rates. The application purposes a 10-storey, 90-unit residential development.
4A total residential GFA of 7,697 square metres is proposed, representing a Floor Space Index of 3.75 times the area of the lot.
