MEMORANDUM OF ORAL DECISION DELIVERED BY S. BOBKA AND M.A. SILLS ON APRIL 14, 2022 AND ORDER OF THE TRIBUNAL
1This was the first Case Management Conference ("CMC") in regard to an appeal by Payzac Development Corporation (the "Applicant") of a Site Plan application for the property located at 4151 Kingston Road in the City of Toronto (the "City").
2The Applicant submitted a Site Plan application to facilitate the development of a nine-storey residential building in July 2020. The City did not make a decision on the application within the statutory timeframe and the Applicant appealed the non-decision to the Tribunal under section 41(12) of The Planning Act ("Act").
3The Tribunal was advised that the Parties have had productive discussions and are optimistic about the possibility of a full resolution. Counsel for the Applicant stated that if resolution was achieved, they would likely withdraw the appeal, with the consent of the City, rather than request a settlement Hearing before the Tribunal.
4The Tribunal directed the Parties to contact the Case Coordinator for the purpose of scheduling a hearing, if necessary, or otherwise, to provide notification of the withdrawal of the appeal.
5The Panel is not seized.
