THIS MATTER having come before the Tribunal for a public hearing on August 2, 2019 and the Tribunal, in its Decision and Order, dated March 17, 2020 (the “Decision”) allowed, in part, the appeals filed by 406-410 Keele Developments Limited;
THE TRIBUNAL having withheld its final Order in respect of the Official Plan Amendment and Zoning By-law Amendments until the preconditions listed in paragraph 35(2) of its Decision are satisfied;
THE TRIBUNAL having been advised that 406-410 Keele Developments Limited has applied for a new Zoning By-law Amendment Application in relation to the Site, which, if approved will render moot the Tribunal’s approval in respect of the requested amendments to Zoning By-law 438-86 and Zoning By-law 569-2013;
THE TRIBUNAL having been advised that the preconditions listed in paragraph 35(2) of its Decision are not required to be satisfied for the Order concerning the Official Plan Amendment to issue;
THE TRIBUNAL ORDERS that the appeal with respect to the Official Plan Amendment is allowed and the Official Plan for the City of Toronto is amended in the manner set out in Attachment 1 to this Order;
AND THE TRIBUNAL ORDERS that the appeal in respect of the Zoning By-law Amendments, as approved in the Tribunal’s Decision, are to remain active and held in abeyance until further notice.
