THIS MATTER having come before the Ontario Land Tribunal (the “Tribunal”) for a public hearing on January 6, 2020 and the Tribunal, in its oral decision on January 6, 2020 and written decision issued on January 27, 2020 (the “Decision”) having allowed, in part, the appeals of the zoning by-law amendment application and the draft plan of subdivision application;
AND THE TRIBUNAL having withheld its Final Order with respect to the zoning by-law amendment and draft plan of subdivision until the conditions, as set out in paragraph 44 of the Decision, are satisfied;
AND THE TRIBUNAL having been advised that the conditions for the release of the Tribunal’s Final Order on the draft plan of subdivision have been satisfied;
AND THE TRIBUNAL orders that the draft plan of subdivision in Attachment “1” and the draft plan of subdivision conditions in Attachment “2” are approved;
AND THE TRIBUNAL orders that, pursuant to subsection 51(56.1) of the Planning Act the final approval of the plan of subdivision for the purposes of subsection 51(58) is to be given by the City of Toronto, being the approval authority in which the subject property is situated.
AND THE TRIBUNAL may be spoken to in the event that the Parties have any difficulty in implementing this Decision and Order.
