THIS MATTER having come on for a public hearing by Video Conference Call on January 26, 2021, and having determined that the appeal under [subsection 51(39)](https://www.canlii.org/en/on/laws/stat/rso-1990-c-p13/latest/rso-1990-c-p13.html) of the [Planning Act](https://www.canlii.org/en/on/laws/stat/rso-1990-c-p13/latest/rso-1990-c-p13.html) (the “Appeal”) should be allowed in part, but ordered the City to provide revised conditions of Draft Approval;
AND THE TRIBUNAL having been provided with the revised conditions of Draft Approval and included in this Order as Attachment 1;
THE TRIBUNAL ORDERS that the [Appeal](https://www.canlii.org/en/on/laws/stat/rso-1990-c-p13/latest/rso-1990-c-p13.html) is allowed, in part;
AND THE TRIBUNAL ORDERS that pursuant to [subsection 51(56.1)](https://www.canlii.org/en/on/laws/stat/rso-1990-c-p13/latest/rso-1990-c-p13.html) of the [Planning Act](https://www.canlii.org/en/on/laws/stat/rso-1990-c-p13/latest/rso-1990-c-p13.html), the City of Brampton shall have the authority to clear the conditions of draft plan approval and to administer final approval of the plan of subdivision.

NOTE 1: Any changes to the conditions (including minor amendments and revisions to the conditions expressly identified in any Comments and Conditions Memos are subject to [Section 51 (41)](https://www.canlii.org/en/on/laws/stat/rso-1990-c-p13/latest/rso-1990-c-p13.html) of the [Planning Act](https://www.canlii.org/en/on/laws/stat/rso-1990-c-p13/latest/rso-1990-c-p13.html) and the amendment to the draft approval shall be deemed to have been made the day after the appeal period is over (the day after the 20-day appeal period), whether or not notice has been issued.
