THIS MATTER having come before the Ontario Municipal Board (the “Board”), now continued as the Ontario Land Tribunal (the “Tribunal”);
AND THE BOARD having heard this matter on May 5, 2013 and issued its Final Order June 12, 2013, as amended by its Decision issued on September 5, 2013 (the “Final Order”), approving the draft plan prepared by Lynn H. Patten dated October 1, 2012 for lands defined as Lots 37, 38, 39 and Part of Lot 36 northeast of King Street and Part of Lots 36, 37, 38 and 39 southwest of Huron Street, Town of Thornbury subject to the conditions of draft plan approval set out in Schedule C to the Final Order (the “Conditions”);
AND THE TRIBUNAL having issued an Order on April 14, 2020 having further extended the lapsing date of draft approval for a one (1) year extension until June 12, 2021;
AND THE TRIBUNAL having issued an Order on April 26, 2021 having further extended the lapsing date of draft approval for a one (1) year extension until June 12, 2022;
AND THE TRIBUNAL having received a request from the Applicant to extend the final approval deadline for one year, from June 12, 2022 to June 12, 2023 and request for revised conditions from the Township of The Blue Mountains;
AND THE TRIBUNAL having received confirmation from the Town of The Blue Mountains and County of Grey indicating that they have no objection to a one (1) year extension and the additional conditions;
THE TRIBUNAL ORDERS that the draft plan approval shall be extended for a one (1) year period having an amended deadline of June 12, 2023 and approves the revised conditions attached as ‘Schedule A’ to this Order.
